1. Overview

JournPad ("we", "us", or "our") provides the website at journpad.com (the "Site") and the JournPad mobile application (the "App"). These Terms of Use (the "Terms") govern your access to and use of the Site and App. By accessing or using the Site or App, you agree to these Terms.

2. Eligibility and Accounts

You must be at least 13 years old to use the Site or App. Certain features may require creating an account; you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

3. What JournPad Does

JournPad is an AI‑assisted journaling product focused on voice capture and reflection. You can record voice notes; we transcribe, structure, and surface insights like summaries, tags, themes, moods, and search. You may optionally enable cloud sync to access your content across devices.

4. User Content and License

You retain ownership of your entries, recordings, and other content ("User Content"). To operate and improve the Site and App, you grant us a limited, worldwide, non‑exclusive, revocable license to host, process, and display User Content solely to provide the services you request (e.g., transcription, summaries, sync). We do not sell your personal information. See our Privacy Policy for details.

5. Acceptable Use

• Do not upload content that is illegal, infringing, or violates others’ rights.
• Do not attempt to interfere with or disrupt the Site or App, including security or access controls.
• Do not use the services to train competing models or to reverse engineer proprietary features.
• Respect device permissions (e.g., microphone, camera) and only record with consent where required.

6. Subscriptions and Billing

We may offer free and paid plans (e.g., Pro). Prices, features, and limitations are described on the Site and may change from time to time. If you subscribe, you authorize us (or our payment processor) to charge the applicable fees and taxes. You can cancel at any time; cancellations take effect at the end of the current billing period.

7. Intellectual Property

We own the Site and App, including software, designs, and trademarks, excluding your User Content. You may not copy, modify, distribute, or create derivative works based on our materials, except as permitted by law or these Terms.

8. Third‑Party Services

We may use service providers (e.g., hosting, storage, email). Their use of data is governed by their terms and policies and our agreements with them. We are not responsible for third‑party websites or services you access via links from the Site or App.

9. Disclaimers

The Site and App are provided on an "as is" and "as available" basis. We disclaim all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non‑infringement. We do not guarantee accuracy of transcriptions or AI‑generated insights.

10. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or revenues, arising from your use of the Site or App. Our aggregate liability shall not exceed the greater of $50 or the amounts you paid (if any) in the 3 months before the claim arose.

11. Termination

You may stop using the Site or App at any time. We may suspend or terminate access if you violate these Terms or if necessary to protect the Site or App. Upon termination, the sections that by their nature should survive will survive (e.g., IP, disclaimers, limitations of liability).

12. Changes to These Terms

We may update these Terms from time to time. We will post updates on this page and revise the “Last updated” date above. Your continued use after changes become effective constitutes acceptance of the updated Terms.
